Divorce and Separation Proceedings, Generally, A. Nature and Validity, 1. In General, \u00a7 1 &#8211; Generally<\/h2>\n<p>Divorce is effected by a judicial decree which terminates the marital relationship and changes the legal status of married parties.[<a href=\"#fn1\" name=\"fn-ref1\">1<\/a>] The two types of divorce which the courts can order are called absolute divorce, or &#8220;divorce a vinculo matrimonii,&#8221;[<a href=\"#fn2\" name=\"fn-ref2\">2<\/a>] and limited divorce, called &#8220;divorce a mensa et thoro.&#8221;[<a href=\"#fn3\" name=\"fn-ref3\">3<\/a>]<\/p>\n<div class=\"feature-para-block\">\n<div class=\"feature-para-name\">Definition:<\/div>\n<p>Absolute divorce, or divorce &#8220;a vinculo matrimonii,&#8221; is a judicial dissolution of the marriage ordered as a result of marital misconduct or other statutory cause arising after the marriage ceremony,[<a href=\"#fn4\" name=\"fn-ref4\">4<\/a>] whereas limited divorce, sometimes referred to as divorce&#8221; a mensa et thoro,&#8221; &#8220;divorce from bed and board,&#8221; or legal separation is a change in status by which the parties are separated and are precluded from cohabitation,[<a href=\"#fn5\" name=\"fn-ref5\">5<\/a>] but the actual marriage is not affected.[<a href=\"#fn6\" name=\"fn-ref6\">6<\/a>]<\/p>\n<\/div>\n<p>The primary effect to be accomplished by a divorce or dissolution is the separation of the parties in a manner that enables each to continue his or her life as free as possible from entanglement with the other.[<a href=\"#fn7\" name=\"fn-ref7\">7<\/a>]<\/p>\n<div class=\"feature-para-block\">\n<div class=\"feature-para-name\">Observation:<\/div>\n<p>A petition for dissolution of marriage advances a single claim, that is, a request for an order dissolving the parties&#8217; marriage, and the other issues in a dissolution case, including custody and support, do not represent separate, unrelated claims, but rather, they are separate issues relating to the same claim.[<a href=\"#fn8\" name=\"fn-ref8\">8<\/a>]<\/p>\n<\/div>\n<p>A limited divorce decree can be revoked, under most statutes providing for such a decree, upon petition to the court and satisfactory proof of reconciliation.[<a href=\"#fn9\" name=\"fn-ref9\">9<\/a>]<\/p>\n<p>The validity of a divorce granted by a state legislature was recognized early in our country&#8217;s history.[<a href=\"#fn10\" name=\"fn-ref10\">10<\/a>]<\/p>\n<div>\n<h2>All case links go to Westlaw and require login.<\/h2>\n<\/div>\n<p>  <a href=\"#fn-ref1\" name=\"fn1\" class=\"footnote-revlink\">1<\/a>  <span>\u00a0<span class=\"cite\">      <a href=\"https:\/\/1.next.westlaw.com\/Link\/Document\/FullText?findType=Y&amp;originatingContext=document&amp;transitionType=DocumentItem&amp;pubNum=0000104&amp;refType=RP&amp;originatingDoc=&amp;serNum=1934114404\" rel=\"nofollow noopener\" target=\"_blank\" title=\"Seuss v.
