V. Exemplary or Punitive Damages, A. In General, \u00a7 556 – Definitions; related terms<\/h2>\n

“Exemplary[1<\/a>] or punitive[2<\/a>] damages” have been defined as damages which are given as an enhancement of compensatory damages because of the wanton, reckless, malicious, or oppressive character of the acts complained of. Punitive damages are different from compensatory or actual damages; they are distinct from and in addition to the actual damage.[3<\/a>]<\/p>\n

The terms “punitive damages” and “exemplary damages” generally have the same meaning.[4<\/a>]<\/p>\n

Punitive damages are not available under the law of some states although when the act involved is wanton, malicious, or oppressive, the compensatory damages awarded may reflect the aggravating circumstances.[5<\/a>]<\/p>\n<\/div>\n
